Mark D. Kramer is a graduate of the University of California Los Angeles and Loyola Law School. He has been a practicing attorney in the field of insurance defense since 1979 and brings a tremendous amount of experience to the mediation field. Formerly a partner in the Los Angeles firm of Fonda and Garrard, he began Kramer & Kramer as the law offices of Mark D. Kramer in 1992. He has taken over 50 cases to verdict, notably numerous automobile accident cases, as well as cases in the fields of Premises Liability, Products Liability, Medical Malpractice, Construction and False Imprisonment. Mark D. Kramer has served as an arbitrator and mediator for the Los Angeles Superior Court for 22 years. He is an AV rated lawyer and has been named a Super Lawyer and one of the top attorneys in Southern California by Los Angeles Magazine. Mr. Kramer is a member of ABOTA. This article covers the fascinating world of compelling arbitration. In short, it may be slightly drier than the script for the movie Airplane. However, in view of the uncertainty in this COVID-19 world surrounding how and when civil jury trials will resume, arbitration may be more appealing than ever. Although the provisions for compelling arbitration are relatively straightforward, there are some nuances and potential pitfalls for the unwary. California public policy favors arbitration as a speedy and relatively inexpensive means of dispute resolution. (Brodke v. Alphatec Spine Inc. (2008) 160 Cal.App.4th 1569 at 1577.)
